This Privacy Policy explains how TitanListing, Inc. collects, uses, discloses, and protects your personal information when you use titanlisting.com and its related services. Please read it carefully before using the Platform.
This Privacy Policy applies to TitanListing, Inc. ("TitanListing," "we," "us," or "our"), a Delaware corporation, and governs the collection and use of personal information through the website at titanlisting.com, including all subdomains, applications, APIs, and related services (collectively, the "Platform").
This Policy applies to all users of the Platform, including Buyers, Sellers, Attorneys/Intermediaries, Lenders, and visitors who have not created an account. Capitalized terms not defined here have the meanings given in our Terms of Service.
This Policy does not apply to third-party websites, services, or applications that may be linked from the Platform. We encourage you to review the privacy policies of any third-party services you access through the Platform.

We do not sell your personal information to third parties for their own marketing purposes. We do not use personal information collected through the Platform for behavioral advertising on third-party platforms without your consent.
The core function of the Platform involves sharing certain information between Users. Specifically:
You control what information you include in your Listing or profile. You should not include sensitive personal information in a Listing that you are not willing to share broadly.
We share information with trusted third-party service providers that help us operate the Platform, including:
These providers are contractually obligated to use your information only to provide services to us and in compliance with applicable privacy law.
When a Seller authorizes Document Vault access for a Lender, TitanListing facilitates the delivery of specified documents to that Lender. Lenders are bound by a Lender Access Agreement that includes confidentiality obligations governing their use of documents received through the Platform.
We may disclose your information if we believe in good faith that disclosure is necessary to: (a) comply with applicable law, regulation, or legal process; (b) respond to lawful requests from government authorities; (c) enforce our Terms of Service; (d) protect the rights, property, or safety of TitanListing, our Users, or the public; or (e) detect, prevent, or address fraud, security, or technical issues.
If TitanListing is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on the Platform before your information is transferred and becomes subject to a different privacy policy.
We may share aggregated or de-identified information that cannot reasonably be used to identify you (for example, aggregate statistics about listing activity or industry trends) for any purpose, including with business partners or the public.
The Document Vault contains sensitive financial and business records. We apply heightened security and access controls to Vault content.
Access to Document Vault contents is governed by: (a) the Seller's explicit authorization; (b) completion of the applicable Verification process by the requesting Buyer or Lender; and (c) any applicable NDA or Lender Access Agreement.
TitanListing logs all Document Vault access events, including the identity of the accessing User, the documents accessed, and the timestamp of access. These logs are retained for a minimum of three (3) years and may be made available to a Seller upon request or in connection with a legal dispute.
TitanListing does not review the contents of documents stored in the Document Vault except: (a) as necessary to provide technical support; (b) when required by law or legal process; or (c) when we have a good-faith belief that a document contains illegal content or material that violates our Terms of Service.
Documents uploaded to the Document Vault are encrypted at rest and in transit. TitanListing uses industry-standard security measures, but cannot guarantee that unauthorized parties will never gain access. Users should not upload documents that they would not be comfortable disclosing if a breach occurred.
We retain your personal information for as long as necessary to provide the Platform, fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Specific retention practices include:
When information is no longer needed for the purposes outlined above, we delete or anonymize it. Note that deletion of your account does not immediately result in deletion of all associated data; some information will be retained as described above.

TitanListing does not use third-party advertising cookies or tracking pixels for behavioral advertising purposes. We do not allow third-party advertisers to place cookies on the Platform.
You can control cookie use through your browser settings. Disabling strictly necessary cookies will impair Platform functionality. Note that cookie preference signals (such as Do Not Track browser settings) are honored to the extent technically feasible.
TitanListing implements a layered security program designed to protect your personal information against unauthorized access, disclosure, alteration, and destruction. Our security measures include:
No security system is impenetrable. In the event of a data breach that affects your personal information, we will notify you as required by applicable law, including applicable state breach notification laws. We will provide notice without unreasonable delay and in accordance with the notification requirements of the states in which affected Users reside.

Oregon residents may have rights under the Oregon Consumer Privacy Act (OCPA), which takes effect July 1, 2024. These rights include the right to access, correct, delete, and obtain a portable copy of your personal data, as well as the right to opt out of the processing of personal data for targeted advertising, sale, or profiling. The Platform is not directed to individuals under the age of 18, and we do not knowingly collect personal information from children under 18. If you are a parent or guardian and believe that your child has provided personal information to us, please contact us at titanlistingadmin@gmail.com and we will take steps to delete such information. If we learn that we have collected personal information from a child under 18 without verification of parental consent, we will delete that information promptly.
The Platform may contain links to or integrations with third-party websites and services. These third parties have their own privacy policies, which we do not control. TitanListing is not responsible for the privacy practices of any third party. We encourage you to review the privacy policies of all third-party sites you visit.
Our payment processing is handled by third-party payment processors. When you make a payment, you are subject to the payment processor's privacy policy in addition to ours. We share only the information necessary to process your transaction.
TitanListing is operated in the United States. If you access the Platform from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.
If you are located in the European Economic Area, United Kingdom, or Switzerland, please note that we do not currently have a legal basis to receive personal data from those jurisdictions and do not actively market to or solicit Users from those regions. If this changes, we will update this Policy and implement appropriate transfer mechanisms (such as Standard Contractual Clauses) as required.
Some browsers offer a "Do Not Track" (DNT) signal. Our Platform is designed to respect DNT signals to the extent technically feasible. We do not engage in cross-site tracking for advertising purposes, which is the primary concern addressed by DNT signals. Our analytics data collection is limited to first-party Platform usage data.
